Abstract:

Amateurs’ search for monuments is becoming more and more popular. However, the enforcement of the regulations on the protection of monuments is not a priority. Searching for monuments with the use of electronic and technical devices as well as diving equipment by amateurs gained popularity mainly in the 1990s. Legal solutions in this matter are strongly related to the evolution of society and the development of technology. The concept of searching for monuments is relatively new in Polish legislation. However, it is possible to trace the evolution of the approach to defining a monument and issues related to finding a monument, which preceded and led to the development of a separate category, which is the search for archeological monuments and artifacts. Archaeologist is a regulated profession. The requirements for those conducting archaeological research are high and may ensure appropriate treatment of the monument and the context of its finding. The regulations grants extensive powers to monument hunters although they do not have any formal education. In addition, if the application for a permit to search for monuments is correctly submitted, the conservation services have no grounds for refusal. Archaeological monuments are the property of the State Treasury. The prospectors contribute to stimulating the illegal trade in monuments (including archaeological ones) and it is not an incidental practice.
