The article above presents the issue of the statutorial term of revoking the security’s imperative character, that is mortgaging the debtor’s real property with compulsory mortgage. Since the provisions had become effective in 2005, they have been a subject of discussion and a practical problem for the Polish jurists. The author not only points out the discrepancy in applying the provisions, but also having considered the ruling of the Constitutional Tribunal that found them unconstitutional, gives her own suggestions of how the problem could be regulated.
