Abstract:

A minor victim, who is to be heard in a criminal trial pursuant to Art. 185a of the Code of Criminal Procedure, should be prepared for this activity, because knowing what is expected of him or her and what will happen gives him or her a greater sense of security. Preparing a minor victim to participate in the interview consists in increasing the child’s ability to give precise and comprehensive statements about the experienced events and mitigating any negative effects related to participation in the interview procedure. Unfortunately, as the research of the Empowering Children Foundation conducted in 2020 shows, the practice of preparing minors for questioning is not entirely consistent with the recommendations provided in the literature. The article deals with the theoretical and practical aspects of preparing an injured minor to be interviewed in a Friendly Interrogation Room and contains de lege lata and de lege ferenda postulates regarding carrying out this activity in the Polish criminal trial.
