Abstract:

The obligation to ensure the protection of human life and health rests with the state, in particular with entities performing tasks in the field of public administration. Only the state and its administration have the appropriate organization and the necessary power to ensure, inter alia, broadly understood safety. The individual is not able to ensure medical safety or care in the event of a sudden health emergency, therefore must exist and its existence must rely on the state. The health safety of citizens depends on the full availability and efficiency of medical services. The phenomenon of full access to medical services is related to the phenomenon ofendless expansion of the demand for them among patients, therefore, not only in Poland, but in most countries around the world, there is a tendency to limit the availability of health services. Due to the limited financial capacity of the state, it is necessary to first provide only the "minimum" of benefits saving life and health. In order to ensure this minimum, the State Medical Rescue system was established in 2006. It is the proper operation of this system that determines whether, in the event of a sudden health threat, the citizens’ lives and health will be protected, and their health safety guaranteed.  

Obowiązek zapewnienia ochrony ludzkiego życia i zdrowia spoczywa na państwie, a zwłaszcza na podmiotach realizujących zadania z zakresu administracji publicznej. Tylko państwo i jego administracja dysponują odpowiednią organizacją i niezbędnym władztwem, aby między innymi zapewniać szeroko pojęte bezpieczeństwo. Jednostka sama nie jest w stanie sobie zapewnić bezpieczeństwa czy opieki medycznej w sytuacji nagłego zagrożenia zdrowotnego, dlatego musi istnieć i opierać swój byt na państwie. Bezpieczeństwo zdrowotne obywateli zależy od pełnej dostępności i sprawności funkcjonowania służb medycznych. Ze zjawiskiem pełnej dostępności do świadczeń medycznych wiąże się zjawisko nieograniczonego wzrostu zapotrzebowania na nie wśród pacjentów, dlatego nie tylko w Polsce, ale w większości krajów na świecie istnieje tendencja do ograniczania dostępności do świadczeń zdrowotnych. Ze względu na ograniczone możliwości finansowe państwa niezbędne jest w pierwszej kolejności zapewnienie tylko „minimum” świadczeń ratujących życie i zdrowie. Do zapewnienia tego minimum został powołany w 2006 r. system Państwowe Ratownictwo Medyczne. To od prawidłowego działania tego systemu zależy, czy w sytuacji nagłego zagrożenia zdrowotnego życie i zdrowie obywateli będzie chronione, a ich bezpieczeństwo zdrowotne zagwarantowane.
