Abstract:

The article has been aimed to approach the current legal status of the agricultural system in Poland. The fundamental regulation of this issue is the Act of 11 April 2003 on shaping the agricultural system in the context of the changes made by the Act of 14 April 2016 on the suspension of the property sale of the Agricultural Property of the State Treasury and the amending of certain acts, and the Act of 26 April 2019 on the amending of Act on shaping the agricultural system. The article presents the basic civil issues contained in the Civil Code, such as the definition of the agricultural property and agricultural holding (farm), property right, perpetual usufruct, lease and autonomous possession. The Author has also introduced cases concerning the exclusion of the provisions of the Act. The following part of the article describes entities entitled to acquire agricultural properties that meet the requirements of all statutory restrictions, and entities entitled to acquire agricultural properties to which no statutory restrictions apply. The Act on shaping the agricultural system in Poland in its current legal status is very restrictive. The legislator has personally and subjectively classified persons who may be buyers of the agricultural property. Protection of the agricultural property against its free market sales raises controversy and uninterrupted discussion.  

Artykuł ma na celu przybliżyć aktualny stan prawny ustroju rolnego w Polsce. Podstawową regulacją tego zagadnienia jest ustawa z dnia 11 kwietnia 2003 r. o kształtowaniu ustroju rolnego w świetle zmian dokonanych ustawą z dnia 14 kwietnia 2016 r. o wstrzymaniu sprzedaży nieruchomości Zasobu Własności Rolnej Skarbu Państwa oraz o zmianie niektórych ustaw i ustawą z dnia 26 kwietnia 2019 r. o zmianie ustawy o kształtowaniu ustroju rolnego oraz niektórych innych ustaw. W artykule przedstawiono podstawowe zagadnienia cywilistyczne zawarte w kodeksie cywilnym, takie jak definicja nieruchomości rolnej i gospodarstwa rolnego, a także prawo własności, użytkowania wieczystego, dzierżawy i posiadania samoistnego. Następnie przybliżono przypadki dotyczące wyłączenia stosowania przepisów ustawy. W dalszej kolejności opisano podmioty uprawnione do nabywania nieruchomości rolnych, które spełniają wymóg wszystkich ograniczeń ustawowych oraz podmioty uprzywilejowane w zakresie nabywania nieruchomości, do których nie stosuje się ograniczeń ustawowych. Ustawa o kształtowaniu ustroju rolnego w Polsce w obecnym stanie prawnym jest bardzo restrykcyjna. Ustawodawca przedmiotowo określił rodzaje gruntów, do których ma zastosowanie ustawa oraz podmiotowo sklasyfikował osoby, które mogą być nabywcami nieruchomości rolnej. Ochrona nieruchomości rolnych przed jej wolnorynkową sprzedażą budzi kontrowersje i nieprzerwaną dyskusję.
