Abstract:

The study addresses the issue of the place of commercial law in the Polish legal system. The understanding of commercial law and the unclear situation of its place in the Polish legal system resulting from the adopted formula of the principle of unity of civil law were described. Via the example of the power of attorney under Art. 210 § 1 of the Commercial Companies Code, the negative practical effects of the existing regulation were presented. They study encourages to discussions on the reform of commercial law legislation in Poland.
