Abstract:

This article aims to study of the influence of the Roman principle vim vi repellere licet, according to which “it is lawful to repel force with force”, on the evolution of justification of self-defense in Polish penal codifications. The author, using the historical-legal and formal-dogmatic method, analyzes both art. 21 Makarewicz’s Code (introduced by ordinance of the President of the Republic of 11 July 1932), as well as art. 22 Andrejev Code (Act of 19 April 1969 – Penal Code) and art. 25 of the currently applicable Penal Code (Act of 6 June 1997 – Penal Code). In conclusion, the author comes to the conclusion that the currently binding institution of self-defense has the widest scope of normalization, which results from the fact that it draws not only on the solutions of previous codes, but also introduces institutions previously unknown to Polish criminal law
