Abstract:

The article deals with the issue of evidence contrary to the law in civil proceedings, focusing on the assessment of the so far developed concepts, by confronting them with the specificity of divorce proceedings on the legal and factual levels. The observations made during the analysis of doctrinal views considering the right to a fair trial, the right to privacy, the principle of information autonomy and the purpose of the proceedings, were used to put emphasis on the anticipated, unacceptable effects of the existing legal status, as well as to formulate conclusions de lege ferenda.
