The interchange fee on the basis of national and EU regulations

Abstract:

The Article concerns long-term discussion between the banking sector and business who accepts payment cards, antitrust authorities of many countries in the field of interchange fees. The article describes a multi-threaded, international dispute, which led to adoption of the Regulation of the European Parliament and the Council on interchange fees in respect of payment transactions carried out on the basis of the card, and two amendments to the law on payment services in Poland. The article describes the genesis of the adopted legal solutions in Poland, shows limited capacity of market’s participants do self-regulation in this filed and ineffectiveness of undertaken administrative actions. Describes also objectives and solutions adopted in the Regulation. Although the Regulation shall be binding in its entirety and directly applicable in all Member States, the Polish law on payment services includes different solutions. The article describes ongoing amendments to the law on payment services and indicates the directions of the necessary changes to the Polish law.
