Abstract:

The commentary regards the matter of the primary term for filing a motion to act as the auxiliary prosecutor. The author of the commentary does not agree with the ruling of the Court of Appeal in Gdańsk, as in her opinion, the argumentation presented by the Court weakens the guarantees of the injured party in the criminal proceedings, in particular, the right to a fair trial. At the same time, according to the author, a motion to act as the auxiliary prosecutor, filed in the preliminary proceedings, is effective in the criminal proceedings as well, therefore, the injured party is entitled to act as a party to the court proceedings.
