The paper presents various ways of understanding the terms: public procurement and contracting authority. Conducted analysis covered views of the representatives of doctrine and the definition of public procurement contained in the Public Procurement Law Act. Legal definition does not express the essence and functions of public procurement as this is not its purpose. The attempts to define this term in public procurement law doctrine can hardly be considered homogeneous and do not cover all cases of purchasing supplies, services or construction works, which in the practice of economic turnover are referred to as public procurement. The aim of the paper is to present the concept of the term of public procurement in a formal and material sense as well as the concept of its narrow and broad understanding. The term of contracting authority is also presented in its narrow and broad sense
