Abstract:

The thesis on judicial intuition adopted so far in Polish legal discourse, under which it is assumed thatintuition is an unconscious process of making judicial decisions, is not confirmed by the latest research of American scholars. The contemporary discourse of American scientists examines the intuition from a new, logical research perspective, replacing the existing, psychological one. The hithertolack of polemic with the position expressed by judge Hutcheson about hunch, today is due to theoutdated achievements in the systems different from American law. The purpose of the articleis to draw attention to the need to undertake research in searching new meanings for judicial intuitionthat will enrich all comparative studies
