Abstract:

Offenses indicated in art. 197-199 of the Penal Code are the most severe crimes against sexual freedom and decency. They leave marks not only on the victim's body, but also on her psyche. Due to the need to provide protection for the victim against secondary victimization, as well as to deepen the trauma suffered as a result of a sexual crime, in 2013. the legislator introduced art. 185c to the Code of Criminal Procedure. The purpose of this provision was to ensure minimum standards for the interview of victims of crime victims of an act of art. 197-199 PC. However, as it turned out in practice, this provision does not provide sufficient protection against secondary victimization. Therefore, the legislator in 2019. amended the content of art. 185c of the CCP, specifying new conditions for the interrogation in this particular mode. The purpose of this article is to identify, describe and evaluate the changes introduced and determine their significance for victims of an offense under art. 197-199 PC.
