The influence of politics on criminal law by the example of attempts at penalizing the Holocaust denial

Abstract:

The article tried to show the negative influence of politics on penal law. The introduction explains the conception of Holocaust denial and presents the most famous cases about using the term „polish death camps”. First part shows the legal status of this crime in Polish Criminal Code from 1969. The next part is the analysis of the article 132a of the Polish Criminal Code from 1997 and of the harmful effect of politicians on penal law. Sequent section analyzes article 55 of the Act on the Institute of National Remembrance, which is the best from this regulations. The next part presents controversy regarding to article 55a and 55b of this Act and interpretation problems. The last chapter is the short summary
