• Abstract:
  
  
  Issues related to the insolvency of entrepreneurs and natural persons who do not conduct business are regulated primarily in two normative acts ‒ the Restructuring Law and the Bankruptcy Law. These regulations have independent character, they aren’t part of commercial law in the strict sense, but they can be included in commercial law in the broad sense. General principles of restructuring and bankruptcy proceedings, i.e. the main values guiding them, are determined by their subject, purpose and functions. In these proceedings are used principles expressed in international and EU law, constitutional principles, economic values, general principles of civil procedure and the main principles expressed explicitly in the acts regulating these proceedings in question and only relevant to them.;
  
  
  
  Zagadnienia związane z niewypłacalnością przedsiębiorców oraz osób fizycznych nieprowadzących działalności gospodarczej uregulowane są przede wszystkim w dwóch aktach normatywnych – Prawie restrukturyzacyjnym oraz Prawie upadłościowym. Regulacje te mają charakter niezależny i samodzielny, nie stanowią części prawa handlowego sensu stricto, ale można je zaliczyć do prawa handlowego sensu largo. Zasady ogólne postępowań restrukturyzacyjnych i upadłościowego, czyli naczelne wartości im przyświecające, determinowane są przez ich przedmiot, cel oraz funkcje. Zastosowanie w postępowaniach tych znajdują zasady wyrażone w prawie międzynarodowym i unijnym, zasady konstytucyjne, wartości ekonomiczne, zasady ogólne postępowania cywilnego oraz naczelne zasady wyrażone wprost w ustawach regulujących przedmiotowe postępowania i tylko dla nich właściwe.
