The author first characterizes populism to determine whether its features appear in the politics of the Law and Justice party. Then the author examines the image of women promoted by the party, and thus the party\u2019s attitude towards women\u2019s rights, in order to finally refer to the limitations of these rights that occurred in Poland after 2015, with the main element of the analysis being the ruling of the Constitutional Courtin 2020. The conclusion is that populists introduce a selective protection of rights, based on the value system they have created, and the jurisprudence of the Court serves as a strategic litigation. And it was through that litigation that significant changes were introduced in women\u2019s rights, that is, more precisely, restrictions on their bodily autonomy."],"pl":["Artykuł jest analizą relacji istniejącej pomiędzy działaniami populistów w Polsce a prawami kobiet oraz miejscem strategicznej litygacji w tej relacji. Autorka rozpoczyna od charakterystyki populizmu, by następnie zbadać, czy jego cechy występują w polityce partii Prawo i Sprawiedliwość. Następnie bada wizerunek kobiety promowany przez partię, a tym samym stosunek partii do praw kobiet, by ostatecznie odnieść się do ograniczeń tych praw, jakie nastąpiływ Polsce po 2015 roku. Głównym elementem zmian podlegającym analizie jest orzeczenie Trybunału Konstytucyjnego z 2020 roku. W toku tej analizy powstaje wniosek, że populiści wprowadzają wybiórczą ochronę praw, opartą na stworzonym przez nich systemie wartości, a orzecznictwo Trybunału służy jako strategiczna litygacja.
