It has a formal character and is in part common, in part individual. It can be assumed \u2014 based partly, on views expressed in doctrine \u2014 that begging included in the Offense Code means insistently asking for material support which allows to characterize the person who requests it as a beggar \u2014 apart from actions such as, i.a., a collection-fundraiser for a socially useful purpose (including suitably, moral etc.) \u2014 which does not violate the dignity and welfare of the collector \u2014 or mutual benefit (excluding sham benefits), which also should not infringe the dignity and welfare of the participants. The victim of the act can be a helpless minor, dependent on the perpetrator and remaining under their guardianship. The author expresses a de lege ferenda postulate regarding the wording of the provision and excluding from its scope \u201ca person remaining under the perpetrator\u2019s guardianship.\u201d"],"pl":["Przedmiotem analizy badawczej są znamiona wykroczenia skłaniania do żebrania, określonego w art. 104 kodeksu wykroczeń. Ma ono charakter bezskutkowy; po części jest powszechne, a po części indywidualne. Można założyć \u2014 opierając się również częściowo na poglądach wyrażanych w doktrynie \u2014 że żebranie ujęte w kodeksie wykroczeń oznacza usilne proszenie o wsparcie materialne, które pozwala scharakteryzować realizującego je jako żebraka, niemniej niebędące zbiórką \u2014 która nie narusza godności oraz dobrostanu zbierającego \u2014 na cel społecznie użyteczny (a w tym godziwy, moralny itd.) czy świadczeniem wzajemnym (z wyłączeniem świadczenia pozornego), które również nie powinno naruszać godności i dobrostanu osób w nim uczestniczących. Pokrzywdzonym rzeczonym wykroczeniem może być małoletni, bezradny, pozostający w stosunku zależności od sprawcy oraz będący pod opieką sprawcy.
