The content of the study also includes the legal nature of a new, specialized entity, which is the Governmental Agency for Strategic Reserves. An attempt was also made to show the wide range of tasks entrusted to RARS. The article discusses the significant, from the point of view of entities representing the State Treasury, the subject of taking over by the newly established Government Strategic Reserves Agency of the ownership of real estates previously owned by the Material Reserves Agency. The thesis demonstrated in the course of the work is that the acquisition of the ownership of the real estate in question does not depend on the issuing of a decision by the competent voivode, but only on the entry into force of the act. In her considerations, the author also did not ignore the issue of rights that so far were established on the property that became the property of the Agency, for a thorough explanation of the dilemmas that may arise from the analysis of art. 75 of the Act on Strategic Reserves. The study emphasizes the importance and role of the Governmental Agency for Strategic Reserves in crisis management, which is reflected in the extension of its ownership rights to real estate necessary for the implementation of its statutory objectives."],"pl":["Celem pracy jest identyfikacja problemów ze stosowaniem przepisów ustawy z dnia 17 grudnia 2020 r. o rezerwach strategicznych, w zakresie dotyczącym nabycia nieruchomości Skarbu Państwa przez Rządową Agencję Rezerw Strategicznych, a także wyjaśnienie wątpliwości dotyczących momentu przejścia owego prawa na rzecz RARS. W treści opracowania ujęto charakter prawny nowej, wyspecjalizowanej instytucji, jaką jest Rządowa Agencja Rezerw Strategicznych. Podjęto także próbę ukazania szerokiego zakresu zadań, jakie powierzono Agencji. Artykuł omawia istotny, z punktu widzenia podmiotów reprezentujących Skarb Państwa, temat przejęcia przez nowo utworzoną Rządową Agencję Rezerw Strategicznych własności nieruchomości, będących dotychczas we władaniu Agencji Rezerw Materiałowych. Tezą wykazaną w toku pracy jest to, iż przejęcie własności przedmiotowych nieruchomości nie jest zależne od wydania decyzji przez właściwego wojewodę, a jedynie od wejścia ustawy w życie. Autorka w swych rozważaniach nie pominęła także problematyki praw, które dotychczas ustanowione były na nieruchomości, stającej się własnością Agencji, w celu dogłębnego wyjaśnienia dylematów, które może rodzić analiza art. 75 ustawy o rezerwach strategicznych.
