  The computerization of public life is inevitably progressing, also affecting courts and notaries. One of the IT tools used in practice by courts and notaries is the system of notarial registers, which has been operating in Poland since 2009 and is constantly evolving. In the existing legal status, the electronic system of Notarial Registers enables the collection and sharing of data processed by courts, Polish notaries and EU notaries, and its operation is based on provisions scattered across several acts and regulations. Currently, this system includes, among others, the Inheritance Register, the Notarial Register of Wills, the Central Repository of Electronic Copies of Notarial Deeds, the Register of Succession Administrators, as well as the Register of Users and the Notarial Statistical Registers. The aim of this study is to summarize the functioning of the notarial register system in the context of court and notarial practice, to discuss the functionality of this system and to analyze the prospects for its development in the constantly changing legal status and in connection with the constant expansion of notaries’ competences. The considerations were supplemented with legal and comparative considerations in the context of the legislation of other European countries and with de lege lata and de lege ferenda postulates.

  Informatyzacja życia publicznego nieuchronnie postępuje, dotykając również sądy i notariuszy. Jednym z narzędzi informatycznych stosowanych w praktyce właśnie przez sądy i notariuszy jest system rejestrów notarialnych, funkcjonujący w Polsce od 2009 r. i nieustannie ewoluujący. W istniejącym stanie prawnym elektroniczny system Rejestry Notarialne umożliwia zbieranie i udostępnianie danych przetwarzanych przez sądy, notariuszy polskich oraz notariuszy UE, a jego funkcjonowanie opiera się na przepisach rozsianych w kilku ustawach i rozporządzeniach. Obecnie system ten zawiera m.in. Rejestr Spadkowy, Notarialny Rejestr Testamentów, Centralne Repozytorium Elektronicznych Wypisów Aktów Notarialnych, Rejestr Zarządców Sukcesyjnych, a także Rejestr Użytkowników oraz Notarialne Rejestry Statystyczne. Celem niniejszego opracowania jest podsumowanie funkcjonowania systemu rejestrów notarialnych na gruncie praktyki sądowej i notarialnej, omówienie funkcjonalności tego systemu oraz analiza perspektyw jego rozwoju w ciągle zmieniającym się stanie prawnym oraz w związku z nieustannym poszerzaniem kompetencji notariuszy. Rozważania uzupełniono o rozważania prawno-porównawcze w kontekście ustawodawstwa innych państw europejskich oraz o postulaty de lege lata oraz de lege ferenda.
