  Meta stattì — predstaviti pravove regulûvannâ, ŝo mìstitʹsâ v Konstitucìï Respublìki Polʹŝa, âke dozvolilo Polʹŝì priêdnatisâ do Êvropejsʹkogo Soûzu. Câ norma mìstitʹsâ v st. 90 Konstitucìï Polʹŝì ì nazivaêtʹsâ «ìntegracìjna klauzula». Z samogo počatku vona bula peredbačena avtorami konstitucìï âk pravova osnova dlâ procesu priêdnannâ Polʹŝì do Êvropejsʹkogo Soûzu. Norma st. 90 Konstitucìï Respublìki Polʹŝa reglamentuê osoblivij vid procedur vislovlennâ zgodi na ratifìkacìû mìžnarodnogo dogovoru, na pìdstavì âkogo Polʹŝa može deleguvati mìžnarodnìj organìzacìï či mìžnarodnomu organu povnovažennâ organìv deržavnoï vladi v pevnih spravah. Taka zgoda može buti viražena šlâhom prijnâttâ zakonu pro ratifìkacìû mìžnarodnogo dogovoru Sejmom, a potìm Senatom. Odnak v oboh vipadkah ce maê buti zrobleno bìlʹšìstû u 2/3 golosìv za naâvnostì ne menše polovini vstanovlenoï zakonom kìlʹkostì deputatìv abo senatorìv vìdpovìdno. Drugij varìant — nadannâ vìdpovìdnoï zgodi na ratifìkacìû šlâhom vsenarodnogo referendumu. Rìšennâ pro vibìr vìdpovìdnoï proceduri v kožnomu konkretnomu vipadku naležitʹ do kompetencìï Sejmu ì prijmaêtʹsâ absolûtnoû bìlʹšìstû golosìv za učastì ne menše polovini viznačenoï zakonom kìlʹkostì deputatìv. Sfera dìï regulûvannâ, ŝo mìstitʹsâ u st. 90 Konstitucìï Respublìki Polʹŝa bula mìnìmalʹnoû ta dostatnʹoû pìdstavoû dlâ priêdnannâ, ale câ norma ne konkretizuê pitanʹ, âkì možutʹ viklikati sumnìvi. Osnovnì nedolìki stattì 90 — vikoristannâ neviznačenih ponâtʹ («nadannâ povnovaženʹ», a takož «mìžnarodna organìzacìâ abo organ»). Prote vìdsutnìstʹ čìtkogo viznačennâ materìalʹnih mež kompetencìj, âkì ne pìdlâgaûtʹ peredačì, pìddavalasâ osoblivìj kriticì. Navedene položennâ Konstitucìï Respublìki Polʹŝa liše vkazuê na te, ŝo «peredačì» ne možutʹ pìdlâgati sukupnostì kompetencìj konkretnih organìv (napriklad, zakonodavčoï, vikonavčoï či sudovoï), a možutʹ buti liše kompetencìï cih organìv u pevnih pitannâh. Odnak takij pìdhìd zališaêtʹsâ duže netočnim sposobom viznačennâ mež delegovanoï kompetencìï. U cìj situacìï êdinim sposobom viznačiti mežì delegovanih povnovaženʹ ê posilannâ na aksìologìčnì cìnnostì, na âkih bazuêtʹsâ Konstitucìâ Respublìki Polʹŝa. U stattì takož nagološuêtʹsâ, ŝo sʹogodnì, pìslâ bagatʹoh rokìv členstva Polʹŝì v ÊS ta zastosuvannâ položenʹ Lìsabonsʹkoï ugodi, âka suttêvo zmìnila principi funkcìonuvannâ Êvropejsʹkogo Soûzu ta deržav-členìv, neobhìdno vnesti popravki v Konstitucìû Respublìki Polʹŝa.

  This article aims to present the legal regulation contained in the Constitution of the Republic of Poland, which allowed Poland to join the European Union. The scope of the regulation contained in Art. 90 of the Constitution of the Republic of Poland provided the minimum and at the same time sufficient grounds for the accession; however, this norm does not specify all issues that may need clarification. The basic defects of Art. 90 include the use of unclear concepts that may raise doubts in the process of their application. Criticism was levelled particularly at the lack of unambiguous specification of the substantive limits of non-transferable competences. The cited provision of the Constitution of the Republicof Poland states only that the “transfer” may not include entire competences of certain bodies (for example, legislative, executive, or judicial), but only the competences of these bodies in certain matters. In the light of this very imprecise way of defining the limits of the competences to be delegated, the only available way to define the limits of the delegated competences is referring to the axiological values on which the Constitution of the Republic of Poland is based. The article also emphasizes that nowadays, after numerous years of Polish membership in the EU, and after the introduction of the provisions of the Treaty of Lisbon, which significantly changed the principles of the functioning of the EU, it is necessary to make appropriate amendments to the Constitution of the Republic of Poland.
