• Abstract:
  
  
  The article is focused on the question of gold-plating – the overimplementation of EU law by the Member States. Since the beginning of the 21st century, as part of the Better Regulation policy, the European Commission has been striving to simplify EU law, consult it better with representatives of the concerned sectors and avoid imposing unnecessary administrative burdens on citizens and entrepreneurs. One of the indicated sources of this type of unjustified restrictions are the actions of the Member States undertaken at the stage of transposing EU directives into national law. The article presents definitions of this problem, called gold-plating, which are used by the EU institutions and the Member States; the development of research on this issue was also discussed. The text analyses the negative effects of overtransposition of EU directives which not only imposes unnecessary burdens and obligations on EU citizens, but may also lead to a destabilisation of EU law and disrupt the proper functioning of the internal market. At the same time, it is noted that the doctrine also indicates some positive effects of the phenomenon and points to cases where overtransposition of a certain directive is justified.

  Artykuł poświęcony jest zagadnieniu gold-platingu – nadimplementacji prawa unijnego przez państwa członkowskie. Od początku XXI w. w ramach polityki lepszego stanowienia prawa Komisja Europejska dąży do uproszczenia prawa unijnego, lepszego konsultowania go z przedstawicielami zainteresowanych sektorów oraz unikania nakładania na obywateli i przedsiębiorców zbędnych obciążeń administracyjnych. Jednym ze wskazanych źródeł tego typu nieuzasadnionych restrykcji są działania państw członkowskich podjęte na etapie transpozycji dyrektyw unijnych do prawa krajowego. W artykule wskazane zostały definicje tego problemu, określanego gold-platingiem, stosowane przez organy unijne i państwa członkowskie, a także omówiono rozwój badań nad problemem. Analizie poddano negatywne skutki nadtranspozycji dyrektyw unijnych, które nie tylko nakładają zbędne koszty i obowiązki na obywateli UE, ale mogą też prowadzić do destabilizacji prawa unijnego oraz zakłócać prawidłowe funkcjonowanie rynku wewnętrznego. Jednocześnie zauważono, że w doktrynie wskazywane są również pozytywne skutki gold-platingu oraz przypadki, gdy nadtranspozycja dyrektywy jest uzasadniona.
