Abstract:

The purpose of this paper is to analyse current legislation on freedom of conscience and faith in the Republic of Poland with special regard to the existing possibilities of refusal to fulfil legal obligations arising from generally applicable law. These considerations shall be based on the judgment of the Supreme Court of the United States in Burwell v. Hobby Lobby Stores, Inc. as well as an attempt to answer a question whether it is possible for a similar situation to occur in the Republic of Poland, considering constitutional and statutory norms binding therein.
