Czasopismo naukowe „Folia Iuridica Universitatis Wratislaviensis” ukazuje się od 2012 roku (do numeru vol. 3 no. 2/2014 ukazywało się pod tytułem „Folia Iuridica Wratislaviensis” ISSN 2299-8322). Zakres tematyczny tekstów obejmuje szeroko rozumiane zagadnienia z zakresu prawa publicznego i prywatnego, a także z historii i teorii prawa.

Abstract:

The purpose of the paper is to analyze the thesis that an agreement between representatives of two different cultures can and should be reached at a theoretical level. The author tries to verify the Theory of Communicative Action proposed by Jürgen Habermas in the light of philosophical reflections of American neopragmatist Stanley Fish. Habermas is one of the most important and widely read social theorists in the post-Second World War era. He is also one of the authors of the concept of deliberative democracy, which holds that, for a democratic decision to be legitimate, it must be preceded by authentic deliberation – disinterested exchange of reasons – not merely the aggregation of preferences that occurs in voting. The foundation of deliberative democracy is, according to the German thinker, a communicative action based on communicative rationality. Stanley Fish, in turn, is one of the most eminent American philosophers of the twentieth and twenty-first centuries. The main area of his scientific activity is the theory of literature, law, and history. In the course of his reflections, Fish constructed the concept of an interpretative communities, which implies an original view on the nature of the process of cognition, status of human convictions or beliefs, nature of communication situation and capabilities of theory. The final conclusion stemming from the reflection on Fish’s philosophy explains why Habermas’ theory is not an adequate tool to reach an intercultural agreement.  

Celem niniejszego artykułu jest podjęcie refleksji na temat tezy, zgodnie z którą zgoda pomiędzy reprezentantami dwóch różnych kultur może i powinna dokonywać się na poziomie teoretycznym. Autor stara się rozważyć teorię działania komunikacyjnego zaproponowaną przez Jürgena Habermasa w świetle filozofii amerykańskiego neopragmatysty, Stanley’a Fisha. Jürgen Habermas jest jednym z najważniejszych i najszerzej czytanych teoretyków społecznych czasów powojennych. Jest jednym z autorów koncepcji demokracji deliberatywnej, zgodnie z którą demokratyczna decyzja jest legitymowalna, jeśli stoi za nią autentyczna deliberacja – bezinteresowna wymiana racji, a nie jedynie suma interesów wyrażona w głosowaniu. Fundamentem demokracji deliberatywnej jest przy tym według niemieckiego myśliciela działanie komunikacyjne, osadzone w ramach racjonalności komunikacyjnej. Stanley Fish z kolei jest jednym z wybitniejszych amerykańskich filozofów XX i XXI wieku. Główną sferą jego aktywności naukowej jest teoria literatury, prawo oraz historia. W toku swych rozważań Fish skonstruował koncepcję wspólnot interpretacyjnych, które implikują oryginalne spojrzenie na naturę procesu poznawczego, statusu ludzkich przekonań, naturę sytuacji komunikacyjnej oraz możliwości, które oferuje teoretyzowanie. Ostateczny wniosek wynikający z refleksji nad filozofią Fisha wyjaśnia, dlaczego teoria zaproponowana przez Habermasa nie jest adekwatnym narzędziem do osiągnięcia porozumienia międzykulturowego.
