The institution of the constitutional referendum corresponds to the fundamental demands of the concept of the supremacy of the people. Numerous constitutions of modern European countries have introduced an obligatory referendum approving the change of the constitution. An atypical solution is the introduction of a referendum in the optional option to the analyzed procedure. This solution has been applied in Poland, but the possibility of holding a referendum has been dependent on a number of additional conditions. The result of the comparative analysis of the provisions of contemporary European states and Polish regulations is the question whether the introduction of a referendum change procedure in Poland results from the real attachment of the constitutional authors to the idea of civic participation, or aimed at creating a façade institution or serving other purposes.
