Abstract:

The article presents the reader with the least-exercised competence of the Polish constitutional court as defined in art. 189 of the Constitution of the Republic of Poland - competency dispute. The previous judicial practice of the Constitutional Tribunal in this subject is relatively modest and boils down to just two decisions. The latest case law is proceedings before the Constitutional Tribunal, initiated by the motion of the Speaker of the Sejm of June 8, 2017 (reference number: Kpt 1/17).  

Artykuł przybliża czytelnikowi najrzadziej wykonywaną kompetencję polskiego sądu konstytucyjnego zdefiniowaną w art. 189 Konstytucji RP – spor kompetencyjny. Dotychczasowa praktyka orzecznicza Trybunału Konstytucyjnego w tym przedmiocie jest relatywnie skromna i sprowadza się do zaledwie dwóch rozstrzygnięć. Najnowszy kazus stanowi postępowanie przed Trybunałem Konstytucyjnym, zainicjowane wnioskiem Marszałka Sejmu z dnia 8 czerwca 2017 r. (sygn. Kpt 1/17).
