Abstract:

The article is devoted to the analysis of the constitutional practice created after the transfer of power by Law and Justice. More and more often, a specific method of functioning of state organs, boiling down to a very instrumental use of law, began to be used. Such a method of action, which can only be called a trick with a lot of good will, can happen incidentally to everybody, even the most care about formal correctness, of power. However, it is reprehensible when its manifestations become a daily way of proceeding. Also because a democratic state cannot use deception in dealing with its citizens.
