Abstract:

The article addresses the problem of answering doubts as to the beneficial effects of using civil law instruments on beneficial relations between the public administration using them and the environment. The author tries to demonstrate that the inference about the administrative nature of some contracts concluded by the administration is too hasty, and in addition - justify that the risk of negative impact of private instruments on these relationships is not so significant.
