Title:

Legal character of the patient’s consent in civil law

Abstract:

The paper is an evaluation of the legal nature of patient’s consent to medical treatment as an example of consent to infringe personal rights. The subject of analysis consists of two contradictory standpoints qualifying patient’s consent as a kind of legal action or the statement similar to a declaration of will. The aim of the author is to qualify patient’s consent as one of the categories of civil events and to determine the scope of application of civil law to this institution.
