Abstract:

Each democratic system relies upon the active participation of the citizens in the process of governance of the State. Such statement shall be interpreted as a derivative of the principle of popular sovereignty which is the basis of every democratic system, but in various legal system is realized with different intensity. The aim of the aforesaid article is to answer the question about possible scope of direct democracy’ mechanisms – particularly if such mechanisms can become a ground for the popular review of judicial decision of constitutional court. The research hypothesis of the article is the notion that introduced into the legal system of Colorado – appellation of sentence institution stands contrary to the standards of democratic State, in its European shape. Simultaneously, the author intends to indicate the advantages of the strong positions of the citizens in the process of self – governance. The aforesaid article shall be treated as an attempt of genuine analysis of the institution of the appellation of sentence, from the perspective of legal security, Constitution supremacy and minority protection principles.
