Abstract:

Recognition of the legal entity is a necessity to guarantee other rights and freedoms. Determining the identity of an individual is very important in the sphere of social and legal relations. Self-awareness and knowledge of biological and cultural roots is a very important element in the mental and physical development of every human being. On the basis of the Convention on the Rights of the Child, parties have an obligation to create the conditions in which children will not only be able to get to know their biological identity, but also to develop a national, ethnic and religious identity. The right to know his or her identity is vital to the proper development of a child. Correct determination of the origin of a child allows the government to protect his or her fundamental rights such as the right to be raised up in the family, the right to education, the right to proper health and social care. It also protects them against unauthorized forcing to work or forced conscription into the army. The undertaken actions are to create a legal and social reality in the way which takes into account the need for special treatment of children due to their immaturity, mental and physical, and the need to prepare them adequately for life in the society.
