This judgment of the European Court of Justice is important for at least two reasons. Firstly, it strengthens the EU’s established line of case-law jurisprudence, regarding qualified breach of law in a form of obvious and grave infringement of the bounds of its discretion. The judgment distinctly indicates the bounds of discretion in a form of due diligence and proportionality; it also clearly shows when they are exceeded. Secondly, this judgment seems to be a precedent regarding the scope of application of the precautionary principle and thus for the protection of the human health and life. In its judgment, the Court pointed out that the precautionary principle can not be used freely, though the Court grants the UE institutions a very wide range of power.
