Abstract:

The Republic of Poland is one of the States-Parties that ratified the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punish-ment, adopted by the General Assembly of the United Nations in New York on 18 December 2002. The objective of the Protocol is to establish a system of regular visits carried out by in-dependent international and national bodies to all places where persons are deprived of their liberty (National Preventive Mechanisms - NPM). The aim of these measures is to prevent tor-ture and other cruel, inhuman or degrading treatment or punishment. The Human Rights Defender, as an independent body reporting only to the Sejm, is the one who has performed the tasks of the NPM in Poland (since 2008), visiting various detention centers, including prisons, rooms for detained persons, sobering-up stations etc. The NPM representatives have the power to regularly examine the treatment of the persons deprived of their liberty in places of detention. They are entitled to make recommendations to the relevant authorities with the aim of improving the treatment and the conditions of the persons de-prived of their liberty and to prevent torture and other cruel, inhuman or degrading treatment or punishment. Besides, the NPM submits proposals and observations concerning existing or draft legislation.  

Rzeczpospolita Polska jest jednym z państw-stron, które ratyfikowało Protokół fakultatywny do Konwencji w sprawie zakazu stosowania tortur oraz innego okrutnego, nieludzkiego lub poniżającego traktowania albo karania, przyjętej przez Zgromadzenie Ogólne Organizacji Narodów Zjednoczonych w Nowym Jorku dnia 18 grudnia 2002 r. Przedmiotem Protokołu jest ustanowienie systemu regularnych wizyt, przeprowadzanych przez niezależne międzynarodowe i krajowe organy, mające dostęp do wszystkich miejsc, w których przebywają osoby pozbawione wolności (Krajowy Mechanizm Prewencji - KMP). Celem tych działań jest zapobieganie torturom oraz innemu okrutnemu, nieludzkiemu lub poniżającemu traktowaniu lub karaniu. Rzecznik Praw Obywatelskich, jako niezależny organ składający sprawozdania jedynie przed Sejmem, wykonuje on także zadania KMP w Polsce (od 2008). W tym okresie przedstawiciele KMP wizytowali miejsca ograniczenia i pozbawienia wolności o różnym charakterze, m. in, zakłady karne, areszty, izby wytrzeźwień i in. Przedstawiciele KMP mają prawo do regularnego sprawdzania sposobu traktowania osób pozbawionych wolności w miejscach zatrzymań. Mają prawo do przedstawiania zaleceń dla właściwych władz w celu poprawy traktowania oraz warunków osób pozbawionych wolności i zapobiegania torturom i innemu okrutnemu, nieludzkiemu lub poniżającemu traktowaniu albo karaniu. Poza tym, KMP przedstawia propozycji i uwagi dotyczące obowiązujących oraz planowanych przepisów.
