Abstract:

In 1991 Poland became a member state of the Council of Europe, signed and then ratified the Convention for the Protection of Human Rights and Fundamental Freedoms. All supplemen-tary protocols to the Convention have not been ratified so far. This article presents the state of ratifying these protocols, the statistics on cases filed against Poland to the European Court of Human Rights and sentences pronounced by the Court. It also discusses the problems con-nected with the enforcement of the Court judgments and the action contributing to the in-crease of the effectiveness of enforcing judgments. This action has brought about notable ef-fects, such as a larger number of judgment enforcement, a smaller number of judgments issued in the cases against Poland by the Court and a smaller number of cases filed to the Court or providing the control of legislation projects, paying special attention to the conformity with the standards of the European Convention on Human Rights.  

W 1991 roku Polska stała się państwem członkowskim Rady Europy, a następnie podpisała i ratyfikowała Konwencję o Ochronie Praw Człowieka i Podstawowych Wolności. Jednak nie wszystkie protokoły dodatkowe do konwencji zostały do tej pory ratyfikowane. W artykule został przedstawiony stan ratyfikacji protokołów, dane statystyczne dotyczące spraw wnoszonych przeciwko Polsce do Europejskiego Trybunału Praw Człowieka i opinii wydanych przez Trybunał. Odnotowano również omawiane problemy związane z egzekwowaniem wyroków sądowych oraz działania przyczyniające się do zwiększenia skuteczności wykonywania orzeczeń. Działania te przyniosły wymierne efekty, takie jak większe liczby wykonywania wyroków, mniejszą liczbę wyroków wydanych w sprawach przeciwko Polsce przez Trybunał, mniejszą liczbę spraw wniesionych do sądu lub zapewniających kontrolę projektów legislacyjnych, zwracając szczególną uwagę na zgodność z normami Europejskiej Konwencji Praw Człowieka.
