Abstract:

This paper deals will the case law pending before the United States Supreme Court: United States v. Grace 461 US. 171 (1983). At that time, according with the provisions of Title 40 United States Code § 13k was prohibited the „display [of] any flag, banner, or device designed or adapted to bring into public notice any party, organization, or movement” on the sidewalks around the building of the United States Supreme Court. Therefore, I decided to describe this case law on the background of American and European legal doctrine (human right system of the Council of Europe and the Polish constitutional previsions).
