The first part of this chapter consists of an analysis of the Texas v. Johnson case, preceded by a general deliberation on symbolic speech and freedom of speech in the American law. The second part concentrates on Polish law as it regards to the issue of desacration of the national symbols, and freedom of speech. The author presented both the statutory law and most precedential judgements. Subsequently, in the very end, conclusion and a few postulates de lege ferenda are stated.
