Abstract:
The article presents the subjective definition of phenomenon of instrumentalisation of an legal institution of municipal company, explaining what this instrumentalisation consist in and who can perform it in practice. The article proposes also the specific methodology of dogmatic and empirical research of an aforementioned phenomenon of instrumentalisation.
Artykuł przedstawia autorskie rozumienie fenomenu instrumentalizacji prawnej instytucji spółki komunalnej, w tym wyjaśnia, na czym polega ta instrumentalizacja i kto jej może w praktyce dokonywać. Artykuł proponuje też określoną metodologię dogmatycznego i empirycznego badania fenomenu instrumentalizacji instytucji prawnej spółki komunalnej.
