Abstract:

The legal regulation of the field circumscribed in the text’s title is characterized by a high degree of generality. This is due to the fact that resolutions of the appropriate organs in this field are discretionary ones. A situation such as this has two – both positive and negative – outcomes: these include, on one hand, the necessary flexibility of action, while on the other hand, a possible danger of false interpretation of public interest, opportunism, and expedience.  

Prawna regulacja wskazanego w tytule obszaru charakteryzuje się wysokim stopniem ogólności, w konsekwencji czego rozstrzygnięcia stosownych organów w tym obszarze są uznaniowe. Bez wątpienia stan taki zapewnia niezbędną elastyczność działań, jednakże grozi także niebezpieczeństwem fałszywej interpretacji interesu publicznego, koniunkturalizmem, oportunizmem.
