Abstract:

The basic attribute of a local self-government unit as a decentralized unit is its legal and factual independence. This independence depends on the way in which the structure of a local self-government unit, its tasks and competences, its property and finances and the government control have been regulated according to law. These elements shape the scope and content of a local self-government unit. Equipping administrative districts (counties, provinces) with the status of legal person (being a carrier of rights), having its own property and following from the above the possibility of being liable for damages due to their own actions should be recognised as basic prerequisites (determinants) of their independence. In the public law sphere, however, this independence is shaped by the provisions of the acts in which there are determined limits of freedom in the scope of performing tasks and competences and the rules of exercising government control over the realization of these tasks.  

Podstawowym atrybutem jednostki samorządu terytorialnego jako jednostki zdecentralizowanej jest jej samodzielność prawna i faktyczna. Samodzielność ta zależy od tego, w jaki sposób uregulowano prawem ustrój jednostki samorządu terytorialnego, jej zadania i kompetencje, majątek i finanse oraz nadzór państwa. Elementy te kształtują zakres i treść samodzielności jednostki samorządu terytorialnego. Wyposażenie gmin (powiatów, województw) w osobowość (podmiotowość) prawną, posiadanie własnego majątku, a także wynikającą z tego możliwość ponoszenia odpowiedzialności odszkodowawczej za własne działania, należy uznać za podstawowe przesłanki (determinanty) ich samodzielności. Samodzielność ta w sferze prawa publicznego kształtowana jest natomiast przepisami ustaw, w których określone zostały granice swobody w zakresie wykonywania zadań i kompetencji oraz zasady sprawowania nadzoru państwowego nad realizacją tych zadań.
