Abstract:

The article was devoted to non-price criteria for tender evaluation concerning the economic efficiency of the public procurement. It presents the basic restriction on the freedom to form such criteria: the ban on giving non-price criteria the shape of the subjective nature, and the requirement of a connection with the subject-matter of the procurement. Also the article raised the problem of the possibility of verification of non-price criteria selection made by the contracting entity on the basis of the principles most economically advantageous tender. The article concludes of a unique opportunity to challenge the compliance of non-price criteria for the selection made by the contracting authority, which manifest lack of connection with economic benefits. The article contains an application of exceptional opportunity to challenge the compliance of the selection of non-price criteria made by the contracting entity due to the obvious lack of connection with real economic benefits.
