Some remarks on the legal position of women in Ancient Rome

Subject and Keywords:

women   Ancient Rome   women’s rights   civil proceedings   criminal proceedings

Abstract:

Despite the existence of voluminous literature on the subject of women in Ancient Rome, which includes various aspects of their legal position, a woman’s right to take part in court proceedings is often overlooked or marginalized. As a consequence, this article is devoted to the active role women played in both civil and criminal proceedings. Issues related to women acting as witnesses or respondents/defendants have been left out. Instead, the author places emphasis on women’s voluntary actions within the framework of the proceedings. In particular, cases that involved women appearing before the court on behalf of other persons are subject to analysis
