Abstract:
The article presents regulations of the civil Polish law concerning protections of elements identity of the deceased person. There were analyzed regulations concerning protection of copyright moral rights, company law and the law on the protection of the heritage of Fryderyk Chopin. The article indicated differences between the structure of the legal protection of personal rights of people living and personal rights of deceased persons. It was proposed answer to the question: why in certain situations, personal rights of deceased persons are protected by law while others are deprived of the protection
W artykule opisane zostały regulacje polskiego prawa cywilnego, które odnoszą się do kwestii ochrony elementów tożsamości zmarłych osób fizycznych. Przeanalizowane zostały regulacje dotyczące ochrony autorskich praw osobistych, prawa firmowego oraz ustawy o ochronie dziedzictwa Fryderyka Chopina. W artykule wskazane zostały różnice w konstrukcji ochrony prawnej dóbr osobistych osób żyjących i praw osobistych osób zmarłych. W treści wywodów zaproponowano odpowiedz na pytanie, dlaczego w pewnych sytuacjach prawa osobiste osób zmarłych podlegają ochronie prawnej w innych zaś tej ochrony są pozbawione
