Abstract:

The publication presents two divergent descriptions of a cemetery area and their pros and cons. The author’s conclusion is that the existing form of an article 6 u.c.z. is defective and there is a requirement for a legal definition of the cemetery area and cemetery. Problems taken into consideration are: legal background when the cemetery area is used for other purposes, legal requirements which need to be fulfilled in this situation and issues related to the ownership of objects located over the grave (e.g. tomb)  

W publikacji przedstawiono rozbieżne poglądy dot. rozumienia pojęcia terenu cmentarnego oraz argumenty za i przeciw każdemu z nich. Autorka dochodzi do wniosku, że redakcja art. 6 u.c.z. jest wadliwa, wysuwając wniosek o potrzebie ustawowego zdefiniowania pojęć cmentarza i terenu cmentarnego. Przedmiotem rozważań jest decyzja będąca podstawą prawną użycia terenu cmentarnego na inny cel, wymogi, które muszą być wówczas spełnione i problem własności przedmiotów stanowiących naziemne urządzenie grobu
