Abstract:

An account of the social networking site user after death. Currently, social networking sites play a significant role in the cyberspace. For many people, the contact with other people within the sites is a considerable part of the interpersonal relationships. A web identity, being a digital reflection of the actual identity, is created in such a state of affairs. Death does not deactivate the profile. This causes a significant gap between the real and virtual identity. Currently, the universal instrument to protect the identity after the member’s death is only a theory of a breach of the personal rights of persons close to the deceased. A range of legal problems is solved by the option of account suspension (account status “In memoriam”) offered by popular portals  

Portale społecznościowe odgrywają obecnie znaczącą rolę w cyberprzestrzeni. Dla wielu osób kontakt z innymi osobami w ramach portali stanowi niemałą cześć relacji interpersonalnych. W takim stanie rzeczy powstaje tożsamość internetowa, będąca cyfrowym odzwierciedleniem rzeczywistej tożsamości. Śmierć nie powoduje dezaktywacji profilu. Dochodzi wtedy do rozdźwięku pomiędzy tożsamością rzeczywistą i wirtualną. Aktualnie uniwersalnym instrumentem ochrony tożsamości po śmierci użytkownika jest teoria naruszenia dóbr osobistych osób bliskich zmarłemu. Szereg prawnych problemów rozwiązuje oferowana przez popularne portale opcja zawieszenia konta (nadanie kontu statusu in memoriam)
