Abstract:

The author considers the question connected with crime of exposing a person to contracting a venereal or infectious disease, a serious incurable disease or a really life-threatening disease (art. 161 § 2 and 3 of the Criminal Code). The article raises such issues as: object-perpetrator, objective side, subject, subjective side. Moreover, it analyses the confluence of provisions issue. The author suggests — from the point of de lege ferenda postulates — that from the art. 162 § 2 CC, the concept of a venereal disease should be deleted, because it is included in the concept of an infectious disease.
