Acquisition by the Government Strategic Reserves Agency of ownership of the State Treasury real estate – pursuant to art. 75 of the “new” Act on Strategic Reserves

The aim of the study is to identify problems with the application of the provisions of the Act of 17 December 2020 on strategic reserves, in the scope related to the purchase of the State Treasury real estate by RARS, and to clarify doubts regarding the moment when this law was passed. The content of the study also includes the legal nature of a new, specialized entity, which is the Governmental Agency for Strategic Reserves. An attempt was also made to show the wide range of tasks entrusted to RARS. The article discusses the significant, from the point of view of entities representing the State Treasury, the subject of taking over by the newly established Government Strategic Reserves Agency of the ownership of real estates previously owned by the Material Reserves Agency. The thesis demonstrated in the course of the work is that the acquisition of the ownership of the real estate in question does not depend on the issuing of a decision by the competent voivode, but only on the entry into force of the act. In her considerations, the author also did not ignore the issue of rights that so far were established on the property that became the property of the Agency, for a thorough explanation of the dilemmas that may arise from the analysis of art. 75 of the Act on Strategic Reserves. The study emphasizes the importance and role of the Governmental Agency for Strategic Reserves in crisis management, which is reflected in the extension of its ownership rights to real estate necessary for the implementation of its statutory objectives.
