Abstract:

The purpose of the gloss is to analyze the legality of introducing compulsory preventive vaccinations. The analyzed decision is a precedential and is of particular importance in the light of the ongoing discussions on this issue. The tribunal's test of proportionality delimits the right to privacy in relation to public health and the protection of the rights of others. It indicates the legitimacy of carrying out mandatory preventive vaccinations, which effectiveness and safety has been demonstrated in scientific research before.
