The article explains some conceptual issues originating from the evolution of right to re-use of the public sector information, developed in the latest EU directive of 20 June 2019 on open data and the re-use of public sector information (further referred to as the “Directive (EU) 2019/1024”). Despite the fact that re-use was introduced in first Public Sector Information Directive of 2003 as a separate right, dependent on national access to information (freedom of information) laws, it began slow transformation into the fundamental right to seek and receive digital open data & information under EU Charter of Fundamental Rights. Such evolution and the recent implementation in Polish Law on Open Data and Re-Use of Public Sector Information of 11 August 2021 may become a lifeline for individuals, private business disappointed with relatively weak and anachronistic Law on Access to Public Information.
