Abstract:

The subject of the article is the analysis of the draft of Artificial Intelligence Act in the context of potential threats of violation of fundamental rights included in the principle of effective judicial protection that may arise from the use of artificial intelligence in the judiciary. Examples of artificial intelligence systems are based both in EU member states and in states outside of EU. The article presents the stages of work on the strategy for the creation of the draft regulation, as well as the specific solutions included in the draft, which aim to ensure the safety of use of artificial intelligence systems. The analysis of the draft is juxtaposed with conclusions on the potential threats to the principle of effective judicial protection and the opinions of non-governmental and international organizations.
