Opening the continuity of administrative enforcement proceedings in the light of the amended provisions of the Act on enforcement proceedings in administration

The main subject of research in this study were the issues of admissibility, method and moment of initiating administrative enforcement proceedings and administrative enforcement. Such a legal situation has been examined, taking into account on the one hand, the protection of the rights of the obliged person, and on the other hand, the nature and effectiveness of enforcement proceedings. The article contains an analysis of selected provisions of the Act on enforcement proceedings in administration after the amendment in 2020 and 2021. The paper also refers to the regulation from before the amendments of the Act on enforcement proceedings in administration. In the opinion of the author, the amendment contains a number of regulations improving and increasing the effectiveness of enforcement proceedings in administration. Some solutions, however, require refinement. The analysis includes questionable issues both within the theoretical and practical field.
