Abstract:

The article answers the most important legal questions posed by those who are planning to buy real estate for a brownfield investment, where pollution of the earth’s surface is located. This study explains legal definition of damage in environment and historical pollution of the earth’s surface. It also advises where to get reliable information on the presence of pollution on the real estate, and who is obliged to report the pollution or damage. The article discusses the methods of carrying out preventive and remedial actions in relation to the environmental damage that has arisen or may occur and the historical pollution of the earth’s surface, including the issue of remediation – soil cleaning procedure. The aim of the study is to indicate the legal obligations of the owner of contaminated real estate and the methodology of proceedings aimed at legal removal of pollution, depending on its type, in order to be able to properly implement an investment in post-industrial areas.
